Bydureon Class Action

|

Bydureon Class ActionThe once-weekly injection drug Bydureon (exenatide) is used to treat type-2 diabetes. The Prescribing Information already contains a “Black Box” warning about a potential risk of thyroid cancer. Our lawyers are concerned about other studies linking exenatide to an increased risk of pancreatitis (pancreatic inflammation) and pancreatic cancer.

UPDATE: Multi-District Litigation (MDL) Established for Product Liability Litigation

August 26, 2013 – Federal judges have centralized 53 pancreatic cancer lawsuits involving Byetta (exenatide), Januvia (sitagliptin), Janumet (metformin and sitagliptin), and Victoza (liraglutide) in the U.S. District Court for the Southern District of California. The Multi-District Litigation (MDL) is similar to a class action, and Bydureon lawsuits could potentially be transferred into this litigation. Click here to read the transfer order for MDL #2452.

Bydureon Class Action Information

If you were injured by Bydureon and you are looking for information about a Bydureon class action, you are not alone. This drug has been linked to a growing number of severe side effects, and our lawyers are concerned that AstraZeneca and Bristol-Myers Squibb have not adequately warned about the risk.

Serious injuries associated with Bydureon:

  • Pancreatitis
  • Acute inflammation of the pancreas
  • Hemorrhagic pancreatitis
  • Necrotizing pancreatitis
  • Pancreatic cancer
  • Thyroid cancer
  • Medullary thyroid carcinoma

Bydureon and Cancer

In 2010, the FDA denied approval of Bydureon over concern about possible heart-rhythm disorders. Although Bydureon is not associated with heart problems, the FDA required the following Black Box warning about thyroid cancer:

“Exenatide extended-release causes thyroid C-cell tumors at clinically relevant exposures in rats. It is unknown whether Bydureon causes thyroid C-cell tumors, including medullary thyroid carcinoma (MTC), in humans.”

The active ingredient in Bydureon, exenatide, has also been linked to reports of pancreatitis and pancreatic cancer. Over time, chronic pancreatitis increases the risk of pancreatic cancer. In 2010, Gastroenterology published a study from researchers at UCLA who linked exenatide to a 2.9-fold increased risk of pancreatic cancer.

About Class Actions and Multi-District Litigation (MDL)

Class actions make sense when a lot of people have similar claims against the same defendant. However, in the United States, class actions are rarely used to resolve a large number of pharmaceutical drug injury lawsuits. Instead, federal judges often establish a special litigation where individual lawsuits from all over the United States can be centralized. This is called a Multi-District Litigation (MDL). An MDL has been established for many drugs in the same class as Bydureon, and Bydureon lawsuits may be transferred into the litigation.

Why Our Law Firm Is Filing Individual Lawsuits as Opposed to a Bydureon Class Action

In 2008, Michael E. Schmidt filed the first Byetta lawsuit in the United States on behalf of a man from Virginia who developed pancreatitis. Byetta contains exenatide, which is the same active ingredient in Bydureon, and both drugs have been linked to a possible increased risk of cancer.

Although Schmidt & Clark, LLP is nationally recognized as a class action law firm, we are concerned that members of a class action could be forced to accept a “low ball settlement” and high attorneys’ fees. We understand that many of our clients have suffered devastating losses, and this is why we work on contingency-fee agreements — you pay nothing unless we win compensation for your injury.

You could receive compensation for:

  • Pain and suffering
  • Medical expenses
  • Lost income or out-of-pocket costs
  • Disability, decreased quality of life
  • Wrongful death
  • Punitive damages
